These Terms & Conditions (“Terms”) govern your use of SurfAndStays.com and all services provided by Surf & Stay, including surf lessons, guiding, and related experiences (“Services”). By booking or using our Services, you agree to be bound by these Terms.

1. Services Provided

Surf & Stay offers:

  • Surf lessons (private and group)
  • Surf guiding and coaching
  • Surf-related experiences and activities

All services are subject to availability, weather conditions, and operational considerations.

2. Bookings & Payments

  • All bookings must be made through our website or approved channels
  • Full or partial payment may be required at the time of booking
  • A booking is only confirmed once payment is received and confirmation is issued
  • Prices are subject to change without prior notice until a booking is confirmed

3. Cancellations & Refunds

By Customer

  • Free cancellation is available up to 24 hours before the scheduled service
  • Cancellations made within 24 hours are non-refundable
  • No-shows are non-refundable

By Surf & Stay

We reserve the right to cancel or reschedule services due to:

  • Unsafe weather or ocean conditions
  • Equipment failure or safety concerns
  • Unforeseen operational issues

In such cases, customers will be offered:

  • Rescheduling, or
  • A full refund

4. Rescheduling

  • Customers may request rescheduling at least 24 hours in advance
  • Rescheduling is subject to availability and suitable conditions
  • We reserve the right to adjust schedules based on weather and safety factors

5. Health & Safety

  • Participants must be physically fit and able to swim unless otherwise agreed
  • You must inform us of any medical conditions, injuries, or limitations before the lesson
  • Surf & Stay reserves the right to refuse service if participation may pose a safety risk

6. Assumption of Risk

Surfing and ocean activities involve inherent risks, including but not limited to:

  • Waves, currents, and marine conditions
  • Collisions with boards or other participants
  • Physical injury

By participating, you acknowledge and accept these risks voluntarily.

7. Liability Waiver

To the maximum extent permitted by law:

  • Surf & Stay is not liable for any injury, loss, or damage sustained during participation, except where caused by proven negligence
  • Customers participate at their own risk

8. Equipment Use

  • All equipment provided must be used responsibly
  • Customers are liable for damage caused by misuse, negligence, or failure to follow instructions
  • Lost or severely damaged equipment may be charged at replacement cost

9. Punctuality

  • Customers must arrive on time for scheduled sessions
  • Late arrivals may result in reduced session time without refund

10. Intellectual Property

All content on SurfAndStays.com, including text, images, branding, and media, is the property of Surf & Stay and may not be used or reproduced without permission.

11. Privacy

Personal information collected during bookings will be handled in accordance with our Privacy Policy and used solely for service delivery and communication.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Sri Lanka. Any disputes shall be subject to the jurisdiction of Sri Lankan courts.

13. Changes to Terms

Surf & Stay reserves the right to update or modify these Terms at any time. Continued use of our services constitutes acceptance of any changes.
